Lessee shall at its own expense, provide and maintain full force and effect insurance covering the equipment consisting of but not limited to camera(s), generator(s), lighting and grip equipment and production vehicle(s) rented hereunder. All equipment coverage shall be insured worldwide and on a replacement cost basis. All vehicle physical damage coverage shall be issued on a worldwide basis if the vehicle(s) are to be used outside of the United States and Canada, and the valuation will be actual cash value. The equipment coverage, the vehicle coverage and the loss of use coverage are to cover the period of time from the date of this lease until the date the equipment is actually repaired and/or returned and/or replaced and full payment for the loss, (if any) as outlined in this agreement has been received by the lessee. Said equipment and vehicle insurance shall name lessor as loss payee, and the rights of lessor under such insurance shall not be affected by any act of neglect or breach of condition by the lessee. All insurance shall be written by an insurer with an AM Best rating of A or better. Said equipment insurance shall cover "All Risks" of physical loss of damage and vehicle physical damage coverage shall include the perils "comprehensive" and "Collision." Lessee shall also name lessor as an additional insured as regards to liability insurance. In the event of a liability loss, property and loss of use coverage shall be deemed to be the primary coverage. Lessee shall provide to lessor a certificate of insurance in compliance with this paragraph prior to delivery of the equipment and/or vehicle(s). Notwithstanding this paragraph, lessee shall remain primarily liable to lessor for full performance under this lease. Lessor may enforce its remedies directly against lessee without resort insurance.
Lessee assumes all risk of loss from the moment the equipment and/or vehicle(s) are set aside on the lessor's premises from the lessor's general inventory until the vehicle(s) and/or equipment have been returned to the rental facility or the termination date in the rental agreement, whichever is later. The responsibility includes but is not limited to transit, location coverage, studio coverage, unmanned location coverage, coverage while on the lesse's owned premises and use or storage on the lessor's premises. Equipment and vehicle(s) which have been rented to the lessee for a period of time, but are storedor inspected and tested in the lessor's facility for the convenience of the lessee, shall be the responsibility of the lessee until the termination date in the rental agreement or the equipment and/or vehicle(s) have been returned to the lessor's general inventory.
Equipment and vehicle(s) will not be deemed to have been returned until all of the following conditions have been met: 1) property has been brought back to the premises during normal business hours; 2) inventory has been completed and a missing and damaged list has been compiled, if needed and 3) the term of the rental contract has expired.
For equipment(including but not limited to camera(s), props, set, and wardrobe) which are picked up or stored by lessor for ultimate use by the lessee, the lessor shall be acting as agent for the lessee. All physical loss for property of others which is transported or stored by the lessor shall remain with the lessee from the biginning of time until the end of time.
Regarding labor, overtime occurs after an agreed amount of time on set(10 or 12 hours). There is no charge for travel for personnel if the shoot is within one hour of driving from The Light House.
Customer is responsible for providing The Light House vehicles with either parking permits or bonded parking. If a Light House vehicle is either issued a summons for a parking violation or towed while on location, the customer will be responsible for all incurred costs.
Equipment and/or expendables that are additions to standard packages are agreed to be billed as ordered and are not considered "Pay-As-Used." Customer is billed based on the number of days the equipment is in their custody.
Renter agrees to insure and and all equipment and/or vehicles provided by The Light House, listing The Light House as loss payee/additionally insured in an amount agreed upon before the shoot begins. Subsequently, the customer accepts full responsibility for any equipment and/or vehicles that are lost, stolen, damaged, or broken on set or in transit.
All rentals and labor are subject to charge if cancelled within 24 hours of scheduled production date.
A customer without a resale certificate or a tax exempt form are subject to 7% New Jersey sales tax on equipment, expendables, and missing or damaged equipment.
Our billing cycle is 30 days from the last day of shotting. Shoots lasting a week or more must be paid at the beginning of each week. If payment will be delayed longer than that, The Light House must be notified. Past due invoices will accrue interest at a rate of 1.5% per month after 30 days.
NOTE: Trucks are inventoried in full both before and after every job. Customer will be notified of any missing or dmaged equipment. Drivers will not be personally responsible for equipment not returned to the truck.
Customer will fill out a credit application before equipment is rented. If, at any time, the customer becomes insolvent, or if representation made by the customer is untrue, or if the customer defaults payment, all of the customer's obligations are immediately due without demand or notice.
